AFSCME Local 375 Administratorship Appeal Response Letter

Excused absence for Breast and Prostate Cancer screenings

City of New York employees will now be entitled to excused leave to undertake a screening for breast or prostate cancer.

Effective July 21, 2016, employees of the City of New York are entitled to take an excused absence for prostate cancer screenings. Chapter 96 of the Laws of 2016 was enacted on July 21, 2016, amending Civil Service Law § 159-c to include New York City's employees among public employees entitled to take excused leave for prostate cancer screenings.

Effective September 25, 2016, New York City employees will be entitled to take an excused absence for breast cancer screenings. On June 12, 2016, Chapter 74 of the Laws of 2016 was enacted, amending Civil Service Law §159-b to include employees of the City of New York among public employees who are entitled to receive excused leave for breast cancer screenings. Professional Development Hours Workshops for Engineers and Registered Architects

Scheduled seminars throughout the D.C. 37 Education Fund provide licensed Professional Engineers and Registered Architects the opportunity to earn Professional Development Hours for license renewal. Engineers are required to have a minimum of 36 development hours as part of the renewal process; 18 of which must be in an interactive classroom setting. These seminars are open to licensed engineers and architects only. (Application form)

Judicial Panel Decision on the Local 375 Administratorship

On August 29, 2016, International President Lee Saunders placed Civil Service Technical Guild, Local 375, AFSCME, AFL-CIO, under an administratorship pursuant to Article IX, Section 37 of the AFSCME International Constitution. ...The matter was referred to the Judicial Panel for hearing pursuant to Article IX, Sections 39 and 40 of the International Constitution.



Based upon the above findings, it is the decision of this administratorship hearing board that President Saunders acted appropriately when he imposed an emergency administratorship upon Civil Service Technical Guild, Local 375, AFSCME, AFL-CIO.

AFSCME Local 375 Stipend Policy

Stipend Policy
Policy Revision Date- September 21, 2016

Effective immediately, NY Local 375 delegates must be present at the beginning of the meeting and remain through the business portion of the meeting to receive the $40 stipend. Delegates are required to sign in before and at the end of each meeting. Beginning with the October 2016 delegates meeting, stipends will be paid by the Local directly to the delegates on a quarterly basis.

Effective January 1, 2017, the stipend for the Local 375 delegate meeting will be reduced to $20 per meeting. In lieu of a stipend, delegates may be reimbursed for actual parking expenses to attend the delegate meeting up to $40 for each meeting. A completed Reimbursement Voucher Form with the original parking receipt attached must be turned in to the Local 375 office no later than the last day of the next month following the meeting. Any delegate who receives the reimbursement for parking will not receive the $20 meeting stipend.

Stipends for all ad hoc and standing committee meeting attendance are suspended. The local may provide a meal or refreshments on a case by case basis. Requests for either should be made by the committee chair to the administrator.

Message to Local 375 Members

Dear Sisters and Brothers of Local 375:

As you may know, last week AFSCME President Lee Saunders placed Local 375 under administratorship. This means that the national union has assumed responsibility for the day-to-day affairs of the local. We have been appointed to serve as the administrators to carry out these responsibilities.

Meeting the needs of all Local 375 members is our top priority. We will implement protocols and procedures designed to:
•   Protect your rights as members;
•   Ensure there is fiscal accountability, responsibility and transparency;
•   Improve the efficiency of the local’s operations, including your
     representation in the workplace.

There will be no interruption of member service. Union representatives will continue to help you resolve job-related issues, and this week we are meeting with the presidents of each chapter to get their input and assess their current needs.

In addition, all chapter officers remain in office and continue to perform their usual functions within the chapter, including holding chapter meetings.  Also, the Local 375 Delegate Body remains as a functioning part of the local’s structure. The next regularly scheduled Delegate Body meeting is set for September 21, 2016.

Message from Administrator John English

Dear Local 375 Members:

I’m writing to let you know that Local 375 has been placed under Administratorship by AFSCME International President Lee Saunders, effective August 29, 2016. 

This means that the International Union has assumed responsibility for conducting the day-to-day affairs of the local, including but not limited to all matters related to representation of you in your employment and the responsible management of the local’s finances.  To carry out these responsibilities President Saunders has appointed me to serve as the Administrator of Local 375 and Brother Chris Wilgenkamp, DC37 Director of Technology and Membership Services, to serve as the Deputy Administrator.

In imposing the administratorship, President Saunders acted pursuant to his authority under Article IX, Section 37 of the International Constitution.  The purpose of the administratorship is to restore full democracy to Local 375 and its more than 7000 members. The sisters and brothers of Local 375 have a right to a fully functioning local -- one with fair and democratic elections, and one in which they can have full participation in the decision making process of the union. The cause of this administratorship is a long-time pattern of conduct by the local of violating these rights.

President Saunders is of the opinion that such conduct cannot or will not be immediately remedied by the local. He has therefore suspended the officers of Local 375 from their positions as officers and from any other positions that they hold by virtue of their office. The decision to terminate the administratorship rests solely with the International President and occurs when the concerns that led to the administratorship have been rectified.
